A competent adult is one who:
- has reached the age of maturity, being old enough to legally consent,
- is of sound mind, meaning, for instnace, is not suffering from mental illness, and
- is not subject to coercion, fraud, or duress.
Because the elements of this definition rely on interpretation, it may be appropriate to employ local communities delegation to determine how each element is proven.
